Favorable court order for current pensioners - former employees of ERT SA and adjudication of accrued earnings

By decision of the Athens County Court (Workers' Procedure) it now justifies retired and former employees of ERT SA by awarding the amounts of their worked earnings for the period they were employees of ERT SA.

In particular, with the 747/2018 decision of the Athens Peace Tribunal (attorney-at-law Loukas Th. Apostolidis) dismissed the relevant objections by the legal representatives of the Greek State for the two-year statute limitation of these claims and accepted that the extension to ERT SA of the provision of article 90 par. 3 of Law 2362/1995 is contrary to articles 4 par. 1 and 20 par. 1 of the Constitution, since preferable treatment was recognized in favor of ERT SA and disadvantageous to the other party. The Court also accepted that the provision of article 90 par. 3 of law 2362/1995 contradicts the principle of proportionality as has been judged in its decisions, from (4/2012 & 12/2013) that the extension of the preferential rate of 6% to ERT was deemed unconstitutional.

This is a very important decision along with the most recent court decision concerning the payment of accrued earnings to former ERT SA employees for the time they have been working there, and in particular, the decision does not accept the objection of a two-year limitation period for these claims.
